These Terms are a binding agreement between you and SupaMail. By accepting them or using the hosted service, you agree to these Terms. If you use SupaMail for an organization, you represent that you have authority to bind it, and “you” includes that organization.
1. Eligibility and accounts
You must be at least 18 and legally able to enter a contract. Keep your sign-in methods, API tokens, MCP tokens, and connected mailbox credentials secure. You are responsible for activity performed with credentials you issue, except to the extent caused by SupaMail.
2. The service
SupaMail synchronizes supported mailboxes and makes mail available through hosted web, API, MCP, webhook, and related interfaces. Managed Hosting stores tenant-scoped mirror data in SupaMail-managed infrastructure. BYO Supabase uses infrastructure you control. SupaMail is a synchronization and access service, not a permanent archive or backup. Features, provider support, and limits may change as the service develops.
3. Your content and instructions
You retain ownership of mailbox data, messages, credentials, configuration, and other material you provide (“Customer Content”). You grant SupaMail the limited rights needed to host, copy, index, transmit, display, and otherwise process Customer Content to provide, secure, support, and maintain the service. You instruct SupaMail to perform that processing and to use the subprocessors identified in the Privacy Notice.
You represent that you are authorized to connect each mailbox and process its contents, including personal data belonging to correspondents, employees, or other people. You are responsible for notices, consents, policies, and other lawful bases required for your use. Do not use SupaMail to unlawfully monitor people or process data you have no right to use.
4. Agents, sends, and third-party services
You decide which agents and applications may access SupaMail. Their outputs and actions can be wrong or unintended. Review permissions, previews, recipients, and messages before authorizing sends. Confirmation and safety controls reduce risk but do not replace your judgment. Mail providers, Supabase projects, AI agents, and other third-party services have their own terms; SupaMail is not responsible for them.
5. Acceptable use
You may not use the service to:
- break the law, infringe rights, or send unlawful spam, malware, or deceptive content;
- access a mailbox, Tenant, or system without authorization;
- evade limits, probe vulnerabilities without written permission, or disrupt the service;
- resell or provide the service to third parties without written agreement; or
- use the service in a way that creates material security, legal, or operational risk.
SupaMail may suspend access reasonably necessary to stop abuse, protect data, or comply with law.
6. Trial, subscription, and payment
The hosted service begins with a seven-day no-card trial. Unless a paid or manually granted entitlement is active when the trial ends, hosted sync and content access may pause. A paid subscription renews monthly until canceled. Current pricing is shown before Checkout; the base plan includes one Mailbox Account and additional Mailbox Accounts may increase the recurring price. Stripe processes payments. You authorize recurring charges, applicable taxes, and quantity adjustments that reflect connected Mailbox Accounts.
You may cancel through the billing portal. Cancellation timing is shown there. Except where law requires otherwise, charges already paid are non-refundable and unused time is not credited. SupaMail may change future prices with advance notice; a change applies no earlier than your next renewal after the notice period.
7. Privacy and data processing
The Privacy Notice explains how SupaMail handles personal data. When SupaMail processes Customer Content on your behalf, the Data Processing Addendum is incorporated into these Terms.
8. Security and confidentiality
SupaMail will use reasonable technical and organizational measures designed to protect Customer Content and will use it only as permitted by these Terms, your instructions, or law. No online service is perfectly secure. Notify hi@supamail.dev promptly if you suspect compromised credentials or unauthorized access.
9. Intellectual property and feedback
SupaMail and its hosted service, branding, and non-public software are owned by the operator and licensors. Open-source components remain governed by their licenses. These Terms grant only a limited, non-exclusive, non-transferable right to use the hosted service. If you give feedback, SupaMail may use it without restriction or payment.
10. Suspension and termination
You may stop using the service and cancel your subscription at any time. SupaMail may suspend or terminate access for material breach, nonpayment, legal requirements, security risk, or discontinuation of the service. Where practical, SupaMail will provide notice and a chance to cure. Export what you need before termination. Retention and deletion are described in the Privacy Notice and DPA.
11. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” SupaMail disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. SupaMail does not guarantee that every message will synchronize, remain available, be found by search, or be handled correctly by an agent. Nothing here excludes warranties that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption. SupaMail’s total liability arising from the service or these Terms will not exceed the greater of US$100 or the amount you paid SupaMail during the 12 months before the event giving rise to the claim.
These limits do not apply to fraud, willful misconduct, death or personal injury caused by negligence, your payment obligations, your infringement or unlawful use, or liability that law does not allow to be limited.
13. Indemnity
If you use SupaMail for business purposes, you will defend and indemnify SupaMail against third-party claims and reasonable costs arising from your Customer Content, your unlawful or unauthorized use, or your violation of another person’s rights, except to the extent caused by SupaMail’s breach of these Terms.
14. Changes
SupaMail may update these Terms. Material changes will be presented for renewed acceptance or otherwise notified in advance where required. Changes do not retroactively reduce rights already accrued. Continued use after the effective date of a properly notified update means acceptance where permitted by law.
15. Governing law and disputes
California law governs these Terms, without regard to conflict-of-law rules. The state and federal courts located in the City and County of San Francisco, California have exclusive jurisdiction, except that consumers may bring claims in any forum and rely on any mandatory law available to them under applicable consumer law. Before filing a claim, contact hi@supamail.dev so the parties can try to resolve it informally.
16. General
These Terms, the Privacy Notice, the DPA where applicable, and the Checkout terms are the entire agreement for the hosted service. If one provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign the agreement without consent; SupaMail may assign it in connection with a reorganization, financing, merger, or sale of the service.
